Terms of Use

These terms describe how we actually work, and the parts that depend on how the site behaves are checked against the code by our test suite. If a term here matters to a decision you are making, email info@sophab.ca and ask us to confirm it in writing.

These terms apply to sophab.ca and the tools on it. Using the site means you accept them. If you do not, please do not use the site. Our Privacy Policy explains what we do with your information and forms part of these terms.

1. What this site gives you

The tools here model a Solar Passive Habitat on your building and estimate what it would cost. The free tools are a visualisation and a budget guide: a mockup on your own photo, a massing model, an elevation, and a cost estimate. They deliberately do not give you a structural verdict on your particular design — sizing the structure is engineering work, and it belongs to the paid plan set, not to a slider on a web page.

2. Estimates are estimates

Every figure on this site is a preliminary estimate, not a quotation and not an offer to contract. It is generated from typical material and labour prices, in the currency and units shown, and before any field measurement.

Real costs move with your site, your access, your finishes, the season and your contractor's schedule. Estimates exclude finishes and electrical until we have measured the site, and they can change once we have. Nothing here is financial, tax or investment advice, and energy or savings figures are modelled projections rather than a promise of performance.

3. Drawings, engineering and permits — please read this one

We do not provide stamped or sealed plans, and we are not your engineer of record. What we produce is an engineer-ready drawing set: the Sophab Arch drawings adapted to your dimensions, with the analysis, load path and foundation reactions worked out so a licensed professional engineer can review the work rather than re-derive it.

Before you build, that set must be reviewed and sealed by a professional engineer licensed in your province, engaged by you and paid directly by you. That engineer, not Sophabulous, takes professional responsibility for the design as built. You are also responsible for obtaining permits and for complying with your local building code, zoning, setbacks and any applicable covenants. Zoning and setback information shown in our tools is a convenience only and is not a legal determination — your municipality's is the one that counts.

One thing to know before you buy drawings: our set is analysed and drawn to the National Building Code of Canada and CSA O86, and every sheet cites them. That is the basis a Canadian permit is reviewed against, so today we issue plan sets for Canadian sites only. A United States permit is reviewed against the IBC or the IRC with the NDS for the timber, and we will not hand a US engineer an analysis performed under a code that does not apply in their state. Project access works anywhere; the drawings follow when that basis exists.

4. What we charge for — delivery and refunds

Most of this site is free: the estimate, the mockup and the report cost nothing. There are two things we charge for, and each is paid in full, once. There is no deposit, no balance to settle later, and no recurring subscription — we do not store your card for a future charge and nothing renews on its own.

  • Project access — a one-time purchase that opens the paid tools for one project for a fixed period, shown to you before you pay. When that period ends, access simply stops; it does not auto-renew and you are not billed again unless you choose to buy again.
  • The engineer-ready plan set — priced from the size of your build, and bought once you know what you want.

The price you are shown at checkout, in the currency shown, is the price we charge — we never bill a different amount or a different currency than the one on the button. Where sales tax applies it is added at your own rate and shown as its own line before you pay — so the total on the payment page is higher than the price on the button, and the difference is tax. Our registration number is 76832 8940 RT0001 and it appears on your receipt, so a business buyer can claim it back.

Card payments are processed by Stripe on Stripe's own secure pages. We never see, handle or store your card number; we receive only a confirmation that the payment succeeded, together with the amount and currency. Stripe's own terms and privacy policy apply to that step.

What you are buying is still an engineer-ready set, not a sealed one. Paying us does not make us your engineer of record and does not change anything in section 3 above: your own licensed engineer must still review and seal the set before you build, and that engineer — not Sophabulous — takes professional responsibility for the design.

Delivery. Your plan set is generated to order from the dimensions you configured, usually within minutes of payment. We email you a private download link and it also appears in your account, where it stays available to you. If a set cannot be produced for your configuration at all, we will tell you and refund you in full.

Refunds. Because a plan set is a custom digital good produced on demand, it is fully refundable up until we generate it, and after that we will still refund it if the set we delivered does not match the dimensions you bought, or if we cannot correct a genuine error in it. What we cannot refund is a delivered set that is simply no longer wanted — a change of plan, a sale of the property, or your engineer recommending a different approach. That is not a criticism of the decision; it is that the work has been done and the drawings are already in your hands. Project access is refundable in full while it is unused, and pro-rated at our discretion afterwards. If you are unsure whether your situation qualifies, write to info@sophab.ca and ask us — we would rather sort it out than have you stuck with something you cannot use.

5. Your account

You can sign in with Google, or with a one-time link sent to your email address, so that your reports stay in one place. Keep access to that email account secure: anyone who can read it can request a sign-in link. Tell us at info@sophab.ca if you think someone else has been in your account, and we can close it at your request.

6. Photos and other things you send us

You keep ownership of the photos, dimensions and notes you upload. By sending them you give us permission to use them to produce your mockup, your report and your plan set, and to keep them in our records. We will not publish a photo of your property, or use it in marketing, without asking you first. Only upload photos you are entitled to upload.

7. Fair use of the site

Please do not attempt to break into, overload, scrape wholesale, or probe the site or its APIs, submit other people's personal information, or use the site to send anything unlawful. We rate-limit requests and may suspend access that damages the service for others.

8. Our content

The site, its text, images, drawings, models and the Sophabulous and Sophab names are ours or our licensors'. You may read, print and share pages for your own non-commercial use. Anything beyond that — republishing, or reusing our drawings in another project — needs our written permission. Deliverables you have paid for are yours to use for the project they were prepared for.

9. Other people's sites

We link to third-party sites and use third-party services (mapping, imagery, sign-in). We do not control them and are not responsible for their content or their practices.

10. Availability

We aim to keep the site up, but we do not guarantee it will be uninterrupted or error-free, and we may change or withdraw features. The site and its free tools are provided "as is", without warranties of any kind to the extent the law allows.

11. Limits on liability

To the extent permitted by law, Sophabulous is not liable for indirect or consequential loss, or for loss of profit, arising from your use of this site or reliance on a free estimate. Our total liability in connection with the site and any free tool is limited to CAD $100, or to the amount you have paid us in the previous twelve months if that is greater. Paid work is governed by the agreement covering that work, and this paragraph does not limit liability that cannot lawfully be limited — including for fraud, or for death or personal injury caused by negligence.

Nothing in these terms displaces your rights under applicable consumer protection law.

12. Governing law

These terms are governed by the laws of the Province of New Brunswick and the laws of Canada that apply there, and the courts of New Brunswick have jurisdiction.

13. Changes and contact
